Public Service Agreement for Art Commissions
This agreement applies to me, SJKarma, hereinafter referred to as the "Artist," and any individual or legal entity, hereinafter referred to as the "Client," who commissions a work of art, hereinafter referred to as the "Product." By commissioning the Artist, the Client agrees to the following terms:

Artist's Rights:
1.1. The Artist retains full copyright over all created artwork unless otherwise specified in a signed agreement.
1.2. The Artist reserves the right to post the artwork on social media or use it in any form, including for promotional purposes.
1.3. If the Client wishes to prohibit the publication of the Product, this must be discussed during the commission process and may require additional compensation.
🕊 Payment and Order Execution Terms 🕊
៚⫸ Payment can be made in full upfront, or split into 50% / 50%.For 50% / 50% payments, the first half must be paid before I begin working. This first payment is non-refundable once I have started the commission. The second half must be paid before the final high-resolution file is delivered.I may decline a request if it’s outside my comfort zone or includes themes I’m not comfortable drawing.Thank you for understanding.
🕊 Cancellation and Refund Policy 🕊
៚⫸ Payments are non-refundable if work has already started and the Artist is within the agreed deadline.
2.2. If the Artist fails to meet the deadline, the Client may choose one of the following options:⫸ Full refund, if the order is only at the sketch stage or has not been started.
⫸ Partial refund, if the work has progressed to the line art, coloring, or rendering stages.
⫸ Alternative compensation, agreed upon by both parties under reasonable conditions.
🕊 Copyright and Usage Rights 🕊
៚⫸ When creating an illustration of the Client’s original character, the Artist retains the copyright to the illustration itself.
The Client may use the Illustration for personal use only.The following are strictly prohibited:⫸ Removing or altering the watermark.
⫸ Using the Illustration for commercial purposes (e.g., sales, marketing, advertisements, merchandise, or printed products), unless a commercial license fee is paid.
⫸ Using the Illustration for NFTs, AI generators, resale, merchandise, or advertising of any kind.
Including the Illustration in blockchain projects or any cryptocurrency-related activities.
⫸ Using the Illustration for propaganda or content promoting harmful ideologies.✦ Personal use:
sharing your commissioned artwork online, such as on social media posts, personal profiles, Toyhouse, personal galleries, or similar platforms. You may also use it as a personal avatar, profile picture, banner, or wallpaper.✦ Monetized Content use: +50%
when the artwork is used as part of monetized or promotional online content, such as streaming, video content, thumbnails, creator branding, paid posts, advertisements, or content made to promote a service, brand, or monetized platform. General personal posting on social media does not count as Monetized Content use.✦ Commercial Use: +80%
For any use where the artwork becomes part of a product, paid project, brand, game, publication, or item that is sold physically or digitally. This includes merch, prints, stickers, charms, card game artwork, game assets, book covers, album covers, visual novels, product graphics, promotional material, and similar commercial projects. If the artwork is being sold, licensed, printed on products, used inside a paid project, or represents a brand/product, it counts as commercial use.
🕊 Client Conduct and Sanctions 🕊
៚⫸ If the Client engages in disrespectful behavior, rudeness, fraudulent activities, or any form of inappropriate conduct, the Artist reserves the right to cancel the order without a refund.
Clients who violate these terms may be blacklisted, and future commissions will be refused.
By placing an order, the Client confirms their understanding and acceptance of these terms.
